Deferred Disposition
If you are not eligible to take a Driver’s Safety Course, you may be eligible to request Deferred Disposition and have your case dismissed upon completion of the deferral.
Deferred Disposition is a probationary period (unsupervised) from 1-180 days that will require you to comply with certain requirements the Judge determines.
You are not eligible for deferred disposition if:
- You received multiple violations on one citation
- You possess a Commercial Driver’s License
- Your violation occurred in a construction zone with workers present
- You are charged with traveling at a speed of 95 miles per hour or more or alleged of traveling more than 24 miles per hour over the posted speed limit.
- You are charged with Passing a School Bus
- You are charged with Failing to Give Info/Render Aid/Leaving Scene of Accident
The following are examples of violations that qualify for Deferred Disposition with the requirements for each:
Moving Violations – (I.E. Speeding - see speed requirements above, Ran Red Light, Ran Stop Sign, Fail to Signal)
- Deferral Period is 90 days
- Cost of the Citation – Call the Court to verify amount
- Must submit copy of Driver’s License
- Cannot commit any new traffic offenses during deferral
- If Defendant is under the age of 25, must also complete a driver’s safety course during the deferral and submit to the Court
Fail to Maintain Financial Responsibility (insurance)
- Deferral Period is 180 days
- Cost - $431.00
- Must provide copy of Driver’s license and current insurance card
- Must maintain insurance for entire deferral period
- Must not commit any new violations during deferral
Possession of Drug Paraphernalia
- Deferral Period is 90 days
- Cost - $581.00
- Must not commit any new violations during deferral
- If under the age of 25, must also complete a 6 hour drug and alcohol awareness program
No Driver’s License
- Deferral Period is 90 days
- Cost - $280.00
- Must not commit any new violations during deferral
Driving While License Invalid
- Deferral Period is 90 days
- Cost - $581.00
- Must not commit any new violations during deferral
No Seatbelt
- Deferral Period is 90 days
- Cost - $184.00
- Must submit copy of Driver’s License and insurance card
- Cannot commit any new seatbelt offenses during deferral
Open Container – Driver/Passenger
- Deferral Period is 90 days
- Cost – Driver - $634.00 Passenger - $581.00
- Must not commit any new violations during deferral
If you do not see your violation listed, please call the Court to verify if you qualify for Deferred Disposition for your violation.
You will need to enter a plea of Guilty or No Contest to the violation. You may use the form you received with your citation or the plea form listed under the 'Pleas' Tab.
If you are making your request via email or mail, all documents must be submitted or postmarked by the appearance date on your citation. The documents listed above must be copies or scans. The Court DOES NOT accept photographs of documents.
If making your request in person, the Court will make copies of your documents and provide all paperwork during your appearance.
DO NOT make a payment on your citation until your request has been approved and you have signed and returned your paperwork to the Court. If your payment is made prior to approval, this will result in a conviction on your driving record and your request will not be processed.
